By using Music by Mike, you agree to these Terms of Use. If you do not agree, do not use the website or its account features.
The service
Music by Mike provides a catalogue of mixes and listener features such as favourites, queues, playback history, progress, preferences, and optional email updates. Mix playback is supplied through YouTube and remains subject to YouTube's availability and terms.
Features may change, be suspended, or be discontinued. We aim to keep the service available, but do not promise uninterrupted or error-free operation.
Accounts
You are responsible for providing accurate account information, protecting your sign-in credentials, and activity performed through your account. Tell the operator promptly if you believe your account has been compromised.
We may restrict or close an account when reasonably necessary to protect the service, comply with law, or address a material breach of these Terms.
Acceptable use
You must not:
- use the service unlawfully or infringe another person's rights;
- attempt unauthorised access or circumvent access controls;
- introduce malicious code or disrupt service operation;
- scrape or automate requests in a way that causes unreasonable load;
- impersonate another person, spam users, or submit deceptive data; or
- probe or test security without written permission.
Content and intellectual property
The Music by Mike site design, original text, branding, and software are owned by or licensed to the site operator. You may use the site for ordinary personal listening, but may not reproduce or distribute protected site material beyond rights granted by law or a separate licence.
Mix audio, video, artwork, titles, and other YouTube-sourced material may belong to their respective rights holders. Nothing in these Terms transfers those third-party rights to you.
Third-party services
The service links to or integrates with third-party services, including YouTube and authentication, hosting, email, analytics, and monitoring providers. Their services are governed by their own terms and privacy policies, and Music by Mike does not control their availability.
Disclaimers and liability
The service and catalogue information are provided on an “as available” basis. To the maximum extent permitted by law, the operator disclaims implied warranties that can lawfully be excluded.
To the maximum extent permitted by law, the operator is not liable for indirect, incidental, special, or consequential loss arising from use of the service or third-party content. Nothing in these Terms excludes rights or remedies that cannot be excluded under applicable law, including the Australian Consumer Law where it applies.
Privacy
The Music by Mike Privacy Policy explains how account, listening, analytics, and reliability information is handled. By using the service you acknowledge that policy; optional analytics still require your separate consent.
Changes
These Terms may be updated when the service or legal requirements change. Revised Terms take effect when published. Continued use after publication means you accept the updated Terms.
Governing law
These Terms are governed by the laws of Australia. To the extent permitted by law, disputes are subject to the non-exclusive jurisdiction of Australian courts.
